TERMS & CONDITIONS

 

These terms and conditions apply to all purchases made from ZOE MOSS.

1. ORDERS & DELIVERY

    All orders placed through this website are subject to confirmation and acceptance by ZOE MOSS.

    ZOE MOSS may vary prices in the event of price changes or mistakes made by suppliers with reasonable prior notice to you. If ZOE MOSS requests payment for increased prices, you may cancel the order by giving notice to ZOE MOSS, which must be received within seven days of the announcement of the increase.

    ZOE MOSS or its agent will deliver the goods you order to the address you specify in your order, within the agreed time frame, subject to their availability. Where the goods are not available you will be notified of this by ZOE MOSS as soon as possible. Anyone at the delivery address who receives the goods will be presumed by ZOE MOSS to be authorised to receive the goods.

    If there is no-one at the delivery address or no-one of appropriate age to receive and pay for the order, ZOE MOSS may charge you additional delivery fees.

    Once the goods are delivered to you, you will own them and it is your responsibility if they are lost or damaged.

    ZOE MOSS reserves the right to restrict sales to retail quantities when supplying resellers and distributors.

    Delivery may take up to 10 working days for domestic orders, depending on the courier company and location. 

    **Delivery for INTERNATIONAL orders may take up to 20 days depending on courier company, location and your country's customs policies, which are out of our control**

    All orders are processed and shipped via the methods described in this website only.

    2. RETURN POLICY

    It's important to us that you are happy with your ZOE MOSS experience. If you are not satisfied with your item or it does not fit we will gladly provide a store credit (provided your returns request meets the criteria). The credit expires in 6 months, and can be used on any item in the store, but not in conjunction with other promotions. If you have your eye on something else right now we do offer exchanges.

    WE DO NOT OFFER RETURNS ON SALES ITEMS.

    However, all returns must be back in stores within 14 days of receiving your item. POSTAGE IS NOT REFUNDED OR ADDED TO YOUR CREDIT. ALL POSTAGE COSTS WILL BE COVERED BY THE CUSTOMER. THERE ARE NO EXCHANGES OR CREDIT NOTES ON SALE ITEMS. 

    All products must be in it original purchased condition with all tags and packaging (excluding tissue paper).

    PLEASE NOTE: You must email us and state a valid reason for your return before we can approve your request. We will not accept a return unless your request has been approved. If we receive your product without confirmation of your refund request it will not be accepted.

    ZOE MOSS reserves the right to deny a refund request based on customer's reasoning.  

    ZOE MOSS is not legally obligated to exchange or give a credit note if you;

    (1) change your mind about a product (this includes when you have found a cheaper product elsewhere, has bought a gift that is unsuitable, or their circumstances have changed and you no longer require the goods)

    (2) knew, or should have known about a fault when the goods were bought.

    (3) are unable to prove from whom and when the item was purchased.

    (4) are responsible for damaging the goods by not following the instructions, or misusing the product.

    3. PRICES & PAYMENT

    For each online order, you must pay:

    - the applicable price for the relevant goods confirmed by ZOE MOSS; and
    - the delivery and handling fee specified on the website at that time.

    Your order and credit card details are safe and secure. All personal and credit card information provided to ZOE MOSS is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet.

    - Payment must be cleared before the goods are dispatched.

    4. YOUR ACCOUNT

    You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify ZOE MOSS in connection with any use (whether authorised or unauthorised) of your user name or password. ZOE MOSS may suspend or cancel your account at any time without prior notice.

    5. PICTURES

    ZOE MOSS aims to include up-to-date pictures of all of the goods on this website. However, our picture of the goods may differ in colour and/or minor details from the actual goods. We recommend you read the care labels on the goods carefully before using the goods.

    6. PRIVACY

    ZOE MOSS will comply with ZOE MOSS’s Privacy Statement. ZOE MOSS will not reveal your personal information to external organisations except for the purposes of fulfilling your order.

    7. LIABILITY

    Any liability of ZOE MOSS in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or a warranty implied by legislation and to the maximum extent permitted by law, at the election of ZOE MOSS is limited to:

    i. in relation to goods, the replacement of the goods or the supply of equivalent goods; and
    ii. in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.


    8. CHANGES TO TERMS

    Each order is governed by the terms and conditions current when the order is placed. ZOE MOSS may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.

    9. APPLICABLE LAW

    All purchases, and these terms and conditions, are subject to the laws of New South Wales and Queensland, Australia.
